Flushmate III Class Action Settlements
- out-of-pocket installation expenses for having installed a Flushmate repair kit, a replacement Flushmate pressure vessel, and/or a replacement toilet; and
- direct property damage caused by a Flushmate System that leaked or burst.
The Flushmate System was installed in certain toilets manufactured by American Standard, Copperfit, Crane, Ecotech, Eljer, Gerber, Kohler, Lamosa, Mancesa, Mansfield, Orion, St. Thomas, Universal Rundle, Vitra, Vitromex, Vortens and Western Pottery. Flushmate Systems are rectangular, black, two-piece vessels made of injection-molded plastic that are located in the toilet fixture’s tank. Please lift the china tank lid of your toilet fixture to locate the serial number of your Flushmate System. The serial number is 16 characters long and is located on the label on top of the Flushmate System as shown on the graphic above. The first six numerals of the serial number are the manufacturing date code. If the manufacturing date code range of your Flushmate System falls between 101497 (October 14, 1997) and 043011 (April 30, 2011), you may be eligible to submit a claim. Please see how to do so by clicking here.
Further information about the class action settlements can be found on the Court Documents and FAQ links on this website, which include links to the UDC Settlement Agreement, the Mergens Settlement Agreement, the Long Form Notice, UDC Plan of Allocation and the Mergens Plan of Allocation.
